      <title>Routinely Lies about Client Debt</title>

           Faking a Nursing Home RAD
           &#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            NSWTG (NSW Trustee &amp;amp; Guardian) routinely claim their clients who are in aged care have a RAD (Refundable Accommodation Deposit) owing even when it is not true. They even lie to NCAT about this, who seem to not mind. Such fraud is an offence
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;a href="http://" target="_blank"&gt;&#xD;
      
           under
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;a href="https://www5.austlii.edu.au/au/legis/nsw/consol_act/ca190082/s192e.html" target="_blank"&gt;&#xD;
      
           Section 192E of the Crimes Act 1900 (NSW)
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      
           . This is can be dishonestly putting their client at
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;a href="https://www.sydneycriminallawyers.com.au/criminal/legislation/crimes-act/fraud/" target="_blank"&gt;&#xD;
      
           "financial disadvantage by deception"
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           in situations where this fictional RAD is used as a rationale to sell the client's property to pay off the imaginary debt. In fact it could also be NSWTG gaining financial advantage for themselves because the money is always secretly invested so that the client never know the true rate of return, only what is passed on to them.
           &#xD;
      &lt;br/&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           In a phone call with APTAGE in about 2023 a NSWTG agent claimed that if a client owned property, the only option for paying nursing home accommodation fees is to pay a RAD. When he was reminded that the regulations changed in 2014 to allow a daily payment option he acknowledged his error but it seems implausible that he would have made a genuine slip-up.
           &#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;a href="/315k"&gt;&#xD;
      
           One client
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            , Dee, was told in writing that a $315k RAD had already been paid, with NSWTG refusing to show evidence (even resisting providing the evidence through a formal summons but NCAT seemed to not mind this contempt).
            &#xD;
        &lt;br/&gt;&#xD;
        &lt;br/&gt;&#xD;
        
            Another client, Lee, was told she had a $453k RAD. The number didn't even match the amounts theoretically charged by the nursing home. At the time of entry
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;a href="https://irp.cdn-website.com/73686c59/files/uploaded/Lee_RAD_prices_2020_brochure_pdf_X-.jpg" target="_blank"&gt;&#xD;
      
           (30 June 2020) it was $349k
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            for single room and at the time NSWTG reported the fake debt to NCAT
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;a href="https://irp.cdn-website.com/73686c59/files/uploaded/Lee_RAD_prices_2023_web.pdf-.jpg" target="_blank"&gt;&#xD;
      
           in 2023 it was $440k
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            for single room. However Lee wasn't even in a single room — she shared a room with three others.
            &#xD;
        &lt;br/&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

            The podcast says often one cannot appeal to the Supreme Court from a failed NCAT hearing. To be specific, this is true when one appeals a Guardianship Division decision  - there is an option to appeal at the NCAT Appeal Panel or the Supreme Court (but not both). An Administrative &amp;amp; Equal Opportunities Division decision
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            must be appealed 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           in the NCAT Appeal Panel first and then, if that fails, a further appeal in the Supreme Court.
           &#xD;
      &lt;br/&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           While audio recording is forbidden in NCAT hearings an official recording is archived for seven years and can be bought for $47.

This is despite Rosslyn being her Guardian. Because she cannot afford from her own pocket the NSW to Tasmania fare, there is a real risk that her Mum's dying wish will remain unfulfilled.</description>

           Contradicting their own stated policy, NSW Trustee &amp;amp; Guardian are obsessed with selling client property and it may be related to undue influence from discredited contractors Black Rock. Despite gag orders preventing stories being told, NSW Trustee &amp;amp; Guardian's own statistics betray their motivation. Read the

            Paul's report focuses on general issues but
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;a href="https://www.nswtrusteeandguardianclientabuse.com/marilyns-story" target="_blank"&gt;&#xD;
      
           here is one particular NSW instance
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            which was not gagged. While the scale of this racket is pronounced in NSW,
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;a href="/ahimsa"&gt;&#xD;
      
           Queensland clients also
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            suffer rapacious sell-offs by the Public Trustee.
            &#xD;
        &lt;br/&gt;&#xD;
        &lt;br/&gt;&#xD;
        
            The following analysis is from APTAGIE member Gary White, posted to FaceBook 27 March 2023:
            &#xD;
        &lt;br/&gt;&#xD;
        &lt;br/&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           For the record, NSW Trustee &amp;amp; Guardian (NSWTG) has had an average of 12,138 clients on its books at the end of each financial year over the last 5 years and has sold on average 614 of their clients’ homes each year over that same period.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            ﻿
           &#xD;
      &lt;/span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           By comparison, State Trustees in Victoria has had approximately 11,400 clients on its books in recent years and has sold on average around 260 of their clients’ homes each year over that same period.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           Even the Public Trustee of QLD (PTQ), which has received so much bad publicity recently over its abuse and exploitation of its clients, is no match for NSWTG. PTQ has had over 10,000 clients under its administration in recent years and has sold approximately 420 of their clients’ homes on average each year in that time frame.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           NSWTG absolutely loves selling their clients’ homes as they, or their staff, are paid handsome spotters fees by the real estate agents that sell the properties. This is said to amount to at least 25% of the agent’s commission for the sale which in turn is usually around 2.5% of the selling price for the property. NSWTG has even been known to agree to  Exclusive Agency Agreements with agents who are prepared to pay even higher levels of spotters fees.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           The rackets do not stop there as it is virtually normal practice for the contents of the properties to simply disappear ahead of the sales and for NSWTG to then blame family members for their disappearance and refuse to cover the losses. Instead, the clients end up paying enormous charges to contractors to prepare the properties for sale when in many cases what NSWTG has been unable to sell off is just put out on the street to be taken away in council kerbside clearances paid for by the client through their council rates.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           Selling of clients’ homes should only occur as a last resort when the clients don’t want them sold but in NSW they are sold regardless as no one is ever held to account for this wilful destruction of clients’ estates. State governments of either political persuasion are happy for this to continue as the money it makes for them is just too good. In addition, they also have the massive stamp duties to look forward  to from the eventual purchasers of the properties that NSWTG sells.

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

            In paragraphs 69-70 NCAT
           &#xD;

            habitually trotted out their
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;

           outdated opinion that NSWTG has an “impeccable reputation”. Nothing could be further from the truth. Firstly, why even bother having a hearing if this is taken as fact?
           &#xD;
      &lt;br/&gt;&#xD;

           Secondly, she ignored the proposed financial manager, Gary White, who told her of
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;

           fraudulent payments authorised by NSWT
          &#xD;
    &lt;/a&gt;&#xD;

            that clients' money had been "lost" - in fact the Tribunal was told in the

    &lt;/span&gt;&#xD;

           $315k debt
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;

      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            to her ACF (Aged Care Facility) for a RAD (Refundable Accommodation Deposit). Conveniently for NSWTG, this would justify selling her house to pay the debt which they claimed existed.
            &#xD;
        &lt;br/&gt;&#xD;
        &lt;br/&gt;&#xD;
        
            Dee asked NSWTG for evidence but they merely sent him an irrelevantly old ACF contract signed before NSWTG even took over. So Dee applied to NCAT (NSW Civil &amp;amp; Administrative Tribunal) to
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;a href="https://irp.cdn-website.com/73686c59/files/uploaded/summons_%24315k_application_and_supporting_docs_redacted.pdf" target="_blank"&gt;&#xD;

          &#xD;

            In the meantime it was shown to be

    &lt;/span&gt;&#xD;

           incompetence by the NCA
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      
           T registrar
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            who didn't see the physical hardcopy response which NCAT received four days earlier. An electronic version was sent to all parties and Dee
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;a href="https://irp.cdn-website.com/73686c59/files/uploaded/summons_%24315k_email_dzj.jpg" target="_blank"&gt;&#xD;
      
           reminded them in email
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            that this was again the
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           irrelevant
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            ACF contract. The same one he pointed to as being irrelevant in the Summons application in the first place.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Nevertheless in the rescheduled hearing the increasingly incompetent NCAT registrar was willing to accept this document as a valid response, admitting to not having read Dee's complaint. Dee finally got NSWTG to admit in the hearing however that no such debt existed.

            There has been a considerable amount of feedback concerning the
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Four Corners programme the ABC put to air on 14th March 2022 titled State Control
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           . The programme was certainly not the groundbreaking one that many of us had been hoping for as it simply expanded on what had already been reported previously through mainstream media sources regarding the large scale abuse and exploitation meted out to our elderly and most vulnerable citizens by corrupt and greedy Public Trustees. These media reports had mostly come out of QLD and Tasmania and they were the two states where Four Corners also put much of its focus.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Four case stories were presented as illustrations of the sorts of abuses, mistreatment and exploitation victims of the guardianship system suffer once placed under the Public Trustees. Four Corners claimed it had been necessary for them to go to the Supreme Court to win the right to have these stories told and the victims identified.. However, three of the four case stories involved victims who had been under the Public Trustee in QLD, where the ambiguous wording of that state’s legislation allows victims under financial administration orders to be identified providing they are not at the same time under the jurisdiction of the Public Guardian. The fourth case from WA involved a client who had died and as a consequence was no longer subject to a protected person order.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The three cases from QLD (one of which later transferred to the ACT) were excellent examples of the fee gouging that goes on as the Public Trustee stripped their clients’ of their assets with exorbitant fees and any other charge they could think up while requiring the clients to live on a pittance to cover their basic every day needs. The WA case, on the other hand, involved a young woman who had been managing her mother’s finances before the Public Trustee took over. The Public Trustee, soon after being appointed, had accused the daughter of stealing from her mother when in reality it was simply a case of the daughter seeking benefits which were outside the scope of what could be reasonably afforded on the mother’s budget. The daughter was later shocked to find out that the Public Trustee had actually spent nearly $12,000 of her mother’s funds in legal costs, mostly in preparing a case to convince the police to prosecute her.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Whilst sympathy can be felt for the daughter in this matter, there were many other far more compelling case stories Four Corners could have used to better illustrate the abuse, exploitation and losses suffered by the clients themselves than what this case did. Rather than merely misusing nearly $12,000 of a client’s funds in legal fees, there are numerous cases where Public Trustees have cost their clients hundreds of thousands of dollars each by using the clients’ funds in legal battles to force the sale of the clients’ homes against the wishes of both the clients and their families. In some cases entire estates have been destroyed in this fashion when these disputes ended up in the Supreme Court. Unfortunately, Four Corners did not make mention of any of these cases when, in NSW at least, this has been just as contentious an issue as the erosion of clients’ estates through exorbitant fees and charges.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In fact, the Public Trustee in NSW did not so much as rate a mention by Four Corners throughout the entire programme. This is despite the fact that NSW Trustee and Guardian (NSWTG) alone holds approximately 45% of the total value of all clients’ assets held by Public Trustees throughout Australia and well over double the assets held by either of the next largest states in Victoria and QLD. What really stands out in NSW is how NSWTG goes out of its way to sell off its clients’ homes when there was never a need to sell them. NSWTG sells up to nearly three times as many properties each year than State Trustees does in Victoria yet State Trustees has only slightly fewer clients (11,459 as against 12,494 for NSWTG). NSWTG, in fact, has described itself as the largest single client for selling properties in Australia but its own clients have suffered horrendous losses as a consequence of those sales.
          &#xD;
    &lt;/span&gt;&#xD;

           It has not just been a case of the losses clients suffer from NSWTG selling their homes but also the loss of all their possessions being kept within their homes and which often simply just disappear when the properties get sold. Instead of receiving compensation over their losses, NSWTG invoices the clients’ accounts with additional charges claiming to be from contractors preparing the properties for sale when it later turns out that the contractors don’t even exist. Four Corners was sent subpoenaed bank records regarding some of these payments along with a court judgement where NSWTG paid $135,000 in damages in one case after the victim took NSWTG to court. However, Four Corners chose not to follow up on any of this material, even though a letter from the Ombudsman confirmed that fraud had taken place, Quite clearly these rackets connected with property sales are a very significant part of NSWTG’s operations each year and should never have been disregarded by Four Corners the way that they were.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Besides the case stories, Four Corners also spoke with several advocates and professionals who have been dealing with the victims. These included Jeff Garrett, Director of legal firm Attwood Marshall Lawyers, and Leanne Groombridge, CEO of Advocacy Tasmania. Leanne Groombridge, in particular, has done an outstanding job in bringing these issues to the attention of the broader public through mainstream media sources, something which is essential if the state governments are to be forced into putting a stop to these rackets. Whilst the Public Trustee in Tasmania is only a very small player in what has been happening, it is undoubtedly the state where real change is the most likely to take place thanks to the splendid work Leanne Groombridge has done. Hopefully, this will lead to meaningful changes in other states as well. The much broader audience Four Corners reached with its programme should certainly help in this regard.

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           It was good that Four Corners and the ABC should finally take an in depth look at the way victims of the guardianship system get treated once they are placed under the Public Trustees, even If they did not go nearly far enough in exposing what is going on. At least many more people are now aware that there is something terribly wrong with our Public Trustees and the system they operate under and will no longer see them as a solution when loved ones lose capacity.
           &#xD;
      &lt;br/&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           What was very concerning, however, was the way Four Corners promoted a Melbourne based woman as a key anti guardianship advocate when in reality she has been a part of operations to disrupt and shut down the anti-guardianship movement here in Australia. We have been gagged from mentioning her by name but we can say she has made approaches to Facebook, to our website hosting providers, the eSafety Commissioner and the police in her efforts to have our websites and groups shut down and our key advocates in NSW and QLD gaoled.
           &#xD;
      &lt;br/&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           It was puzzling that Four Corners should have even been promoting this woman in the first place as it had been the QLD advocacy group, Expose the Public Trustee of QLD, which made the initial public exposures in QLD and which had led to the Four Corners exposé and not the woman from Melbourne that Four Corners had promoted instead.. Unfortunately, the QLD group did not so much as rate a mention in the exposé for the pivotal role they had played in these exposures. At this stage there are no active anti-guardianship groups operating in Victoria and this Melbourne based woman travels to other states where there are such groups operating to carry out her disruptive activities.

           NCAT Refuses to Summons Evidence Central to Hearing

           Dee faces eviction from the family home which he lives in and also runs with lodgers - half of the rent pays his Mum's aged care fees, the other half pays The Public Trustee (who do almost nothing except scheme ways to sell the home to profiteer). His Mum had her pension cancelled which threatens the viability of the current situation, but Dee believes she could have it resumed if The Trustee would perform their legal duty and declare the rent earned to MyAgedCare (which Dee suspects they have not done),
          &#xD;

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;br/&gt;&#xD;
        
            It seems that the NSW Civil &amp;amp; Administrative Tribunal (NCAT) is helping NSW Trustee &amp;amp; Guardian to hide potential welfare fraud with a registrar

      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;

           NSW Trustee and Guardian (NSWTG) alone holds approximately 45% of the total value of all clients’ assets held by Public Trustees throughout Australia and well over double the assets held by either of the next largest states in Victoria and QLD. 
          &#xD;

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           What really stands out in NSW is how NSWTG goes out of its way to sell off its clients’ homes when there was never a need to sell them. NSWTG sells up to nearly three times as many properties each year than State Trustees does in Victoria yet 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           State Trustees has only slightly fewer clients (11,459 as against 12,494 for NSWTG). NSWTG, in fact, has described itself as the largest single client for selling properties in Australia but its own clients have suffered horrendous losses as a consequence of those sales.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;

           For more than five years Dee, a pensioner, has used the family home as a base from which to visit his mother (a NSWTG cient) in her aged care facility.

&lt;/div&gt;&#xD;

           NSWTG tried once already to sell the house, defying the arithmetic of their own figures, and losing in an NCAT Tribunal hearing because they failed to consider her human rights associated with Dee's visits.
